Many Americans and Canadians have a common misconception that it is illegal for foreigners to own property in Mexico because of article 27.1 of the Mexican constitution, which prohibits foreigners from acquiring direct ownership of lands or waters within a zone of approximately 66 miles from a foreign border or approximately 33 miles form a coast, known as the “restricted zone”. However, in 1993, Mexico adopted the Foreign Investment Law (FIL), which amends article 27.1, allowing foreigners to own residential property in the “restricted zone” exclusively through a “Fideicomiso”. A Fideicomiso, (which continues to be one of the most commonly misunderstood legal instruments in residential real estate), is a trust agreement where a bank serves as a trustee, and has a fiduciary obligation to the buyer, or “beneficiary”. The beneficiary of the trust (the buyer) retains and enjoys full rights of ownership of the property, including the right to use, mortgage, lease, modify, and sell the property as desired. Despite the beneficiary of the trust having the same absolute rights as if owned directly (fee simple) in the United States and Canada, the indirect ownership (trust) structure, renewable every 50 years, naturally confuses most buyers and unfortunately results in the common misconception that foreigners are prohibited from owning a piece of the Mexican dream.

Many buyers are wondering how this market is for investment or risk so here is the bottom line as I see it with 30 hours a week in the field and talking to many developers daily.
The market is a little softer for Americans but Canadians have filed in with Europeans. Most of the activity and demand is higher than supply as an example if a good buy comes up, its gone quickly especially under $200k far quicker under $150* this market is tough to find and sells fast*
No prices are not falling but some developers are more open to discounts.
In this region I see 1 sale a day average in Summer, 3 to 4 a day in Winter by the agent network.
This region is independant of the US market and is not falling but there are very good buys within the sectors. A house beachfront that was selling for $1.4 mil 6 months ago may take an offer 5% lower for cash.
Almost all sales here are by cash, if you need finance please contact me before you fly in to buy.
Buying is not complicated at all, a contract is signed by seller and buyer and a Notary does the rest,
usually for 5% in closing costs.
How does an American or Canadian have legal protection?
You select either a bank trust or Mexican corporation, I recommend a Corp if you plan to live here. The property is then registered in one of these 2 options and good for life.

An example of what I see is a new complex of 24 condos 4 blocks from the beach, within 60 days they are gone with prices ranging from $180 to $250k. It's not just foreigners buying, 80% of most properties in this region are bought by Mexicans so it is strong demand that pushes the market.
